Tree Work Acknowledgment, Assumption of Risk & Release of Liability

1. Parties
This agreement is between Jewel Creek Tree Service of the Boundary region, British Columbia (the "Company"), and the person signing below (the "Client"), who confirms they are the owner of the property identified in the signing form, or are authorized by the owner to sign on the owner's behalf, for the tree work described in the signing form (the "Work") at that property (the "Property").
2. Acknowledgment of Inherent Risk
The Client acknowledges that tree work of every kind — including tree removal and felling, trimming and pruning, land clearing, stump grinding, and emergency or storm work, and in particular the removal of dead, dying, decayed, storm-damaged or leaning trees ("hazardous trees") — involves inherent risks that remain even when the Work is performed carefully by experienced professionals with proper equipment. These risks include, without limitation: hidden internal decay or structural weakness in a tree that cannot be detected before or during the Work; unpredictable reaction of wood under load; sudden changes in wind or weather; limited work zones close to buildings and other structures; falling, thrown or rigged wood and debris, including during chipping; the movement of heavy equipment and vehicles across lawns, driveways and other surfaces to reach the work area; and ground conditions affecting equipment, personnel and falling debris.
The Client acknowledges that the Company has explained the specific risks of this Work, that the Client has had the opportunity to ask questions, and that the Client accepts these risks with that understanding.
3. Specific Risks Identified for This Job
The risks identified for this Work may include possible damage to any of the following at or near the Property, as discussed with the Client and indicated in the signing form: the house or other buildings; driveways, walkways and other hard surfaces (including damage from equipment access); vehicles, trailers and equipment; lawns, gardens and landscaping, including trees and plants being retained; fences and gates; and above-ground or buried utilities and services.
4. Client Responsibilities
- Move vehicles, trailers, and movable valuables out of the work area when asked to do so before the Work begins. The Client accepts responsibility for items the Client chooses to leave in the work area after being asked to move them.
- Keep all people and pets out of the work area for the duration of the Work.
- Disclose to the Company, before the Work begins, any known hazards or vulnerable installations on the Property, including septic systems, irrigation lines, buried services, wells, and property-line constraints.
5. Assumption of Risk and Release
To the fullest extent permitted by applicable law, the Client assumes the risk of, and releases, waives and discharges the Company and its owners, employees and contractors from, all claims, demands, losses and liability for damage to property — including, without limitation, damage to buildings, driveways, vehicles, landscaping, fences, and services — arising out of or in any way connected with the Work, including claims arising from the negligence of the Company. The Client further agrees not to make any claim against, and to indemnify and hold harmless, the Company in respect of any such damage.
This release applies to the Work described in the signing form and to any additional or follow-up tree services performed by the Company for the Client at the Property, unless a separate written agreement is signed for that later work.
6. Limits of This Release
Nothing in this agreement excludes or limits any liability that cannot be excluded or limited under the laws of British Columbia. If any part of this agreement is found to be invalid or unenforceable, that part will be severed and the remainder will continue in full force.
7. Electronic Signature
The Client agrees that completing and submitting the signing form below, including typing their full legal name in the signature field, constitutes their electronic signature and has the same effect as a handwritten signature under the Electronic Transactions Act (British Columbia), and consents to receiving and keeping records of this agreement electronically.
8. Governing Law
This agreement is governed by the laws of British Columbia and the federal laws of Canada applicable in British Columbia.
